A MAN attacked his cousin after a drunken bust up on a bus on the way home from a family wedding.

Robert Mcilwraith of Brocheil Farm in Girvan was turned away at the door when he tried to apologise to the man before then smashing his home window.

The 26-year-old will now have to pay fines totalling £750 for his antics on November 10 last year.

Depute Fiscal Lindzi Bayne told the court: “On November 9 2018 the accused was attending a wedding in Stranraer. At around 12.30am he along with other members of the public and family boarded a private bus back home.

“During the journey back, he became disruptive and aggravated and was under the influence of alcohol. People tried to calm him down.”

Ms Bayne continued to explain that Mcilwraith was adamant someone made remarks towards him but it was all in his mind. He thought someone was calling him names as he staggered around on the bus.

He then got off the bus with family members on Main Street in Ballantrae, and started cursing and hurling abuse at his cousin before striking him on the face.

The nuisance caused his victim a cut to his left eye who went home straight away. But soon after, Mcilwraith rushed to his door begging for forgiveness. Ms Bayne added: “He tried to apologise at this time but the complainer shut the door on him.

“The complainer later heard a crack. The accused had broken a window, could see small hole and crack in window and he was arrested at this time.”

The drunk’s solicitor Mr Tony Currie told the court: “This is a matter of real regret to Mr Mcilwraith. Everyone had a good time at the wedding. He was standing on the bus, others were asking him to sit down. He struck this man once who is his cousin.”

Mr Currie added: “It was clearly a family matter. Everyone had too much to drink.”

Sheriff Desmond Leslie made reference to a previous Community Payback Order Mcilwraith was on which only ended a year ago before fining him a total of £750. Sheriff Leslie told him: “It’s quite clear you haven’t learned your lessons from the past. These are certain circumstances that can’t be tolerated.”
