A MAN has been caged after he failed to provide two specimens of breath on different occasions in Cumnock and Ayr.

Patrick Doran refused to complete the breathalyser test in August last year at Caponacre Industrial Estate .

Just 12 months later Doran refused to provide a specimen of breath at Ayr Police Officer after he was found driving a van on Whitletts Road.

The 35-year-old appeared from custody before Sheriff Mhari Mactaggart at Ayr Sheriff Court last week.

Speaking on his behalf, defence solicitor, Mr Duncan, said: “There are two analogous matters, one year apart. Mr Doran has been remanded since August 1.”

Addressing the dock, Sheriff Mactaggart, said: “Failing to provide a specimen of breath is a very serious matter. I have given consideration to the report and what was said on your behalf by Ms Malloy and Mr Duncan.

“I have come to the view that a custodial sentence is only appropriate.”

Doran, who lives in Blackpool, has been jailed for 15 weeks and has been disqualified from obtaining or holding a driver’s licence for 18 months.
